The Town of Milton has different permits to suit your needs for your projects and events. For information about fees, check the User Fee By-law.

Please note that the Town will not issue a permit for work within a regional road allowance. It is the applicant's responsibility to verify the road's jurisdiction before submitting an application. This applies to road occupancy permit work zones, as well as entrance permits for properties that front onto a regional road. Refunds will not be issued for applications submitted.

Curb cut and entrance permit

You need a curb cut and entrance permit before you make any modifications to an existing entrance or construction of a new entrance within the Town of Milton's road allowance.

A warning clause is registered on title for all lots within subdivisions registered after the year 2000 prohibiting these modifications. There is no exception or appeal process for this.

Please note that the Town of Milton will not be issuing entrance permits for any properties within the limits of the asphalt overlay program. Any applications received will be cancelled or deferred until the following calendar year.

Can my entrance be widened?

If you live in a newer subdivision, widening the entrance is not be permitted. Any subdivision registered from year 2000 to present has a clause registered on title for every lot stating “purchasers and/or tenants are advised that due to the limited on-street parking, the Corporation of the Town of Milton will not issue driveway curb cut widening permits.” It's the applicant’s responsibility to ensure their property is eligible for entrance widening prior to making an application. Any applications submitted for properties which are not eligible for a widening will not be refunded the application fee.

How wide can I make my entrance?

The maximum width permitted for entrances is based on the Town of Milton Zoning By-law. The location of street furniture (street lights, utility boxes, fire hydrants, etc.) also dictate how wide the entrance can be.

Who will perform the work?

It is the responsibility of the applicant to retain a contractor to perform this work provided that the insurance and security deposit requirements of the Town are met. The Town may choose to complete the entrance work when feasible.

When will the work take place?

Entrance work is only be permitted between April 1 and Oct. 31. Any work requested outside of these dates will be deferred to the following permitted period.

Every entrance permit application is subject to the application fee prior to review by Town staff. All applications that proceed past the initial review will also be subject to a minimum of one inspection fee. All fees are in line with the Town of Milton User Fee By-law.

How long does it take to get an entrance permit?

The Town requires a minimum of five business days once an application has been successfully submitted for review. Town staff will be in contact with additional information once they’ve had a chance to review the submission. Timing may also depend on the status of other approvals that may be required (building permit, site plan, Conservation Halton, Niagara Escarpment Commission, etc.). In general, please allow up to 30 business days for a permit to be issued.

Please note that fees are for the review of the permit, and are non-refundable. There is no guarantee of approval with this fee.

Fees per permit type:

  • $603 application fee for residential (HST exempt)
  • $1,801 application fee for non-residential (HST exempt)
  • Minimum of one inspection fee of $501 plus applicable taxes will apply to all applications
  • Cost for the installation of a rural entrance will be determined through the review of the permit

Road occupancy permit

You need a road occupancy permit prior to commencing any work, project or bin storage located within the Town’s road allowance (i.e., boulevard, sidewalk, and/or roadway). You cannot work or store material without first obtaining this permit. We evaluate each location individually.

When do I need a road occupancy permit?

A road occupancy permit is required prior to commencing with any work for the storage of any bin/material within the Town’s road allowance. The road allowance is the Town of Milton’s property which spans from property line to property line. Road allowance typically includes the sidewalk, grassed boulevard, curb, roadway, etc.

Do I need insurance to work within the Town’s road allowance?

Applicants must provide a Certificate of Insurance (COI), satisfactory to the Town, describing the operations/locations etc. with Commercial General Liability for no less than $5 million per occurrence, coverage for bodily injury, including death and property damage. The Certificate of Insurance must name the Town of Milton as Additional Insured and Certificate Holder, including cross liability and severability of interests clauses and providing for 30 days’ notice of cancellation or material change, signed by the insurance agent.

Street party permit

Are you and your neighbours planning a street party? You will need a permit to close the road. This permit is free. You should apply for this permit at least four weeks before your event.

Application timeline

You must submit your permit application at least five business days before the date that you will need it. If you do not provide us with five days' notice, we may not be able to process the permit on time.
